These Terms of Service are an agreement between you and TrueSession, Inc. for your use of HomeSession™. Please read them. By creating an account or using HomeSession, you agree to these terms. If you do not agree, please do not use HomeSession.
The short version
HomeSession is a tool, not a clinic. It does not diagnose, treat, or replace professional care.
You must be 16 or older. Teens 16 and 17 need a parent or guardian's consent, and subscriptions are purchased by an adult.
The trial is free, and no card is needed. You get full access for 7 days. To keep using HomeSession after that, you choose a plan and subscribe.
You own your content. We host and sync it so you can use the service.
You can cancel anytime, and keep access until the end of the period you paid for.
This short version is a summary for convenience only. The full terms below are what govern your use of HomeSession.
1Accepting these terms
HomeSession is a product of TrueSession, Inc., a Delaware corporation based in Houston, Texas. In these terms, "HomeSession," "we," "us," and "our" mean TrueSession, Inc. "You" means the person who uses HomeSession.
By creating an account, starting a trial, or otherwise using HomeSession, you confirm that you have read and agree to these terms and to our Privacy Policy, which is part of this agreement.
2Who can use HomeSession
You must be at least 16 years old to use HomeSession. If you are 16 or 17, you may use HomeSession only with the knowledge and consent of a parent or legal guardian, and any subscription must be purchased and managed by an adult who can form a binding contract. HomeSession is intended for parents, caretakers, and older teens in a caretaking role. Children under 16 do not create accounts and are not the users of the service. By using HomeSession, you confirm that you meet these requirements and that the information you provide is accurate.
If you enter information about a child, you confirm that you are the child's parent or legal guardian, or that you otherwise have the authority to do so.
3What HomeSession is and is not
HomeSession is a self-guided tool that helps you run skill sessions at home, write your own goals and cues, log what happens, and keep your own record of progress. SessionAssist™ offers gentle, optional suggestions based on what you log.
HomeSession is not a clinic, a healthcare provider, or a medical device. It does not diagnose, treat, or provide medical, clinical, behavioral, or therapeutic advice, and it is not a substitute for evaluation or care from a qualified professional. The goals and content in HomeSession are authored by you. HomeSession does not recommend a course of treatment, and any suggestion it offers is informational only.
We do not promise any particular result. Outcomes depend on many factors outside our control. You are responsible for the decisions you make using HomeSession, and you should consult a qualified professional for diagnosis, treatment, or clinical guidance.
4Your account
You sign in with your email address and a one-time code, so there is no password to manage. You are responsible for keeping access to your email secure and for activity that happens under your account. Please let us know promptly if you believe someone has gained access to your account without permission.
You agree to provide accurate information and to keep it current. We may refuse, suspend, or close accounts that violate these terms or that we reasonably believe create risk for other people or for HomeSession.
5Trials, subscriptions, and billing
Free trial
We offer a 7-day free trial that does not require a payment method. The trial gives you full access to HomeSession. When your trial ends, you must subscribe to a paid plan to continue using the service. Nothing is ever charged unless you choose a plan and subscribe.
Subscriptions and renewal
HomeSession is offered as a recurring subscription on a monthly or annual basis, at the price shown when you subscribe. Subscriptions are purchased through the app store on your device, such as Google Play or the Apple App Store, and are billed by that store. Your subscription renews automatically at the end of each billing period, at the then-current price, until you cancel. By subscribing, you authorize the applicable store to charge your payment method for each period.
Canceling
You can cancel at any time in your device's app store subscription settings. When you cancel, your subscription stays active until the end of the period you have already paid for, and it does not renew after that. To avoid being charged for the next period, cancel before your current billing period ends. Your free trial requires no cancellation; it simply ends, and nothing is charged.
Refunds
Except where required by law, payments are non-refundable, and canceling does not entitle you to a refund for the current period. If the law in your location gives you a refund or cancellation right, we honor it.
Price changes and taxes
We may change our prices. If a change affects your renewal, we will give you advance notice and the chance to cancel before it takes effect. Prices may not include taxes, which we may add where required.
Payment processing
HomeSession subscriptions purchased in the app are collected by the app store where you downloaded HomeSession, such as Google Play or the Apple App Store, under that store's terms and privacy policy. If you purchase a service from us on our website, such as a BCBA directory listing, that payment is processed by Stripe. In all cases, we never receive or store your full card number.
6The BCBA directory
HomeSession offers an optional directory of Board Certified Behavior Analysts®. The directory is a way to discover and contact independent professionals. It is your choice to use it. An analyst you find through the directory acts as your advisor and consultant and may help you design the goals and program you run at home. You, not the analyst, run the at-home sessions, and HomeSession is not a venue for the delivery of direct treatment.
HomeSession is not a party to any relationship or agreement between you and an analyst. We do not provide, supervise, host, or record the consultation or services an analyst provides, we do not take a portion of your payment to that analyst, and a listing is not an endorsement, recommendation, or guarantee of any analyst's qualifications, services, or results. You are responsible for evaluating any professional you choose to work with. Your dealings with an analyst, including any services, fees, and information you share, are between you and that analyst.
7Your content
Your content is yours. This includes the goals, cues, logs, notes, and other material you create in HomeSession. You keep all rights you have in your content.
So that we can operate the service for you, you grant us a limited, non-exclusive license to store, copy, sync, and display your content as needed to provide HomeSession to you and your account, and for no other purpose. We do not use your content to advertise, and we do not sell it. Photos you add stay on your device and are not uploaded to us, as described in our Privacy Policy.
You are responsible for your content and for having the right to enter it, including any information about a child. You agree not to enter content that is unlawful or that infringes the rights of others.
8Acceptable use
When using HomeSession, you agree not to:
use it for any unlawful purpose or in violation of these terms;
access another person's account or data without permission;
interfere with, disrupt, or attempt to gain unauthorized access to the service or its systems;
copy, modify, reverse engineer, or create derivative works from the service, except where the law allows it;
resell, sublicense, or commercially exploit the service without our written permission;
upload malicious code or use the service in a way that could harm others or HomeSession.
9Our intellectual property
HomeSession, including its software, design, text, graphics, and logos, is owned by TrueSession, Inc. or its licensors and is protected by intellectual property laws. HomeSession™, TrueSession™, and SessionAssist™ are trademarks of TrueSession, Inc. Subject to these terms, we grant you a limited, personal, non-transferable, non-exclusive license to use HomeSession for your own caretaking use. We reserve all rights not expressly granted.
BCBA and Board Certified Behavior Analyst are certification marks of the Behavior Analyst Certification Board®, used to refer to that certification.
10Third-party services
HomeSession relies on third parties to function, including Stripe for payments, our database and authentication host, and app stores such as Google Play for distribution and updates. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services, and their availability is outside our control.
11Disclaimers
HomeSession is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that HomeSession will be uninterrupted, error free, or secure, or that it will meet your needs. As stated above, HomeSession does not provide medical or clinical advice, does not diagnose or treat, and does not guarantee any outcome. You use HomeSession at your own discretion and risk, and you remain responsible for decisions about care.
12Limitation of liability
To the fullest extent permitted by law, TrueSession, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of HomeSession.
To the fullest extent permitted by law, our total liability for any claim arising from or related to HomeSession will not exceed the amount you paid us for the service in the twelve months before the event that gave rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13Indemnification
You agree to indemnify and hold harmless TrueSession, Inc. and its officers, employees, and agents from any claims, losses, and reasonable expenses, including legal fees, arising from your misuse of HomeSession, your content, your violation of these terms, or your violation of any law or the rights of a third party.
14Suspension and termination
You may stop using HomeSession at any time and may delete your account from within the app. We may suspend or end your access if you violate these terms, if we are required to by law, or if continuing to provide the service creates risk for other people or for HomeSession. When your account ends, your right to use the service stops, and we handle your information as described in our Privacy Policy. Sections that by their nature should survive, such as content ownership, disclaimers, limitation of liability, and indemnification, will survive termination.
15Changes to the service and terms
We are actively building HomeSession, so the service will change over time. We may add, modify, or remove features. We may also update these terms. When we make a material change to the terms, we will update the date at the top and, where appropriate, give you notice in the app or on the website. Your continued use of HomeSession after a change takes effect means you accept the updated terms.
16Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. If a dispute arises, we ask that you first contact us so we can try to resolve it informally, and we will do the same. If a dispute cannot be resolved informally, it will be brought in the state or federal courts located in Harris County, Texas, and you and we consent to the jurisdiction of those courts, except where applicable law gives you the right to bring a claim elsewhere.
17General
These terms, together with our Privacy Policy, are the entire agreement between you and us regarding HomeSession, and they replace any earlier agreements on this subject. If any part of these terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our consent. We may transfer ours in connection with a merger, acquisition, or sale of assets, or as otherwise permitted by law.
